Terms of Service

Please read over our Terms of Service carefully before ordering.

When you accept to work with us by making your first payment, you are in full agreement to these terms of service.

Ordering:

You must be over the age of 18 in order to enter a commission agreement with us.

By placing an order and agreeing to the commission, you understand that you are ordering a hand made, one of a kind costume/prop made by an artist. They may and can contain imperfections, flaws, and inconsistencies.

You commission must also be accepted by us in order to start the ordering process. You must pay your deposit in order to confirm your commission spot.

Quotes and Deposit:

Quotes are only valid for 30 days from the original date of the quote unless otherwise stated. Posted prices on the website are a guideline and will not be accepted as an obligation or an offer to sell any goods listed therein; a quote is required for all work.

After receiving and agreeing to an official price quote, a 30% NON-REFUNDABLE deposit must be paid in order to reserve your commission slot (a quote alone does not reserve your spot). If a completion date has not already been determined, I will provide you with an estimated completion date once your deposit has been paid. Initial quotes do not include the cost of shipping.

Payments:

I must receive the remainder of your balance (plus shipping) by the commissions estimated completion date. Please plan for these payments accordingly and let me now as soon as possible if an issue arises and you are unable to pay your balance on time. Payments may be broken down into chunks over the course of the commissions construction.

Please be advised that I do work on commissions in order they are paid for (ie. If customer 3 has their commission completely paid off and you (customer 2) are still making payments, I will work on customer 3s commission while you continue to make payments).

I will NOT ship out any commissions until it has been paid (including shipping) in FULL. If your commission is not paid for within one month after completion and I have not received any communication in regards to this from you, the completed piece will be auctioned or sold to another buyer.

Shipping is not included in the original quote and must be calculated and paid for by the customer upon completion.

Cancellations and Refunds:

I reserve the right to cancel or decline a commission for any reason. I may decline a commission if I receive to many price quotes, it will not work in my style, it is a copyrighted character, etc.

In the extreme circumstance that a commission is canceled part way through the construction process (client is overly rude, giving unreasonable demands, cancels of his/her own free will, commissioner is unhappy with the product and attempts to adjust the commission are not working, I feel I cannot complete the commission as originally planned, etc) I will refund any balance you have paid with the exception of the 30% deposit. The commission will then be sold to another buyer.

There is no refund on the original 30% deposit. After the commission has been completed, there is no refund option.

Shipping:

Shipping is not included in the original quote and must be calculated and paid for by the customer upon completion.

International customers are responsible for all customs fees and/or taxes on their commissions. Packages will not be marked as a “gift” to avoid fees, so please do not ask.

Measurements and Duct Tape Dummies:

If you are commissioning a full body costume for an individual performer, I MUST have a duct tape dummy (DTD) from you. If you do not know how to do this, you can follow this useful tutorial:

I will also need two head measurements and your shoe size. If you are commissioning a partial costume for an individual, a kigurumi, or a prop, a duct tape dummy is not necessary but can be sent if you would like a more tailored fit. Additional measurements may be needed.

The cost to ship the duct tape dummy (DTD) will be the responsibility of the customer.

Communication:

Communication will take place strictly over email (Facebook, Twitter, or other social media inquiries about your commission will be redirected to email).

If you have a rush order, please respond to e-mails within 24 hours or I reserve the right to extend the deadline or cancel the commission.

Verbal communication once a project has been started (in person, Skype, phone calls, etc) is not accepted.

Style and Edits:

I strive to bring my commissioners vision to life. However, due to the nature of this art form, my style will come into play. I use similar eye shapes, expressions, and airbrushing techniques for a consistent style. This will not be changed to match another artists or style.

I am more than willing to make minor edits throughout the building process to better fit concept art or ideas. However, if I feel it is unreasonable or will damage the piece, I reserve the right to refuse edits. Large edits may be done at an hourly rate.

Reference Art:

Reference art of the piece and/or every character is required with the exception of an artistic liberty or free reign commission. It is your responsibility to provide me with reference sheets, photos, or other images that are your property or that you have received permission to use. If I feel the reference images you have provided are not adequate, I reserve the right to request further reference images or cancel the commission.

Repairs and Warranty:

CrowsNest Creations has a 30 day repair warranty on all our costumes. In the unlikely even that a commission is damaged due to construction (ie. Seam coming loose) or it does not fit properly, ship it back to our studio and we will repair it for free. We require that all customers package their costume carefully and pay for the initial shipping back to us. We will cover the shipping to return your commission to you.

If commissions are damaged or dirty due to abuse and neglect, we will not repair it and your warranty will be void. Repairs past the warranty date are available for an additional cost; please contact us.

Durability:

We strive to make our costumes and props as durable as possible, however, they are pieces of art and do need to be treated with care. Mistreatment of your commission (smoke or water damage, pulling on wires, improper packing, taking it through mud or dirt, etc) will void your warranty and we are no longer responsible. Your commission is a piece of art and is not indestructible. They often involve airbrushing, small details, and will withstand the test of time with proper care. Liability:

I am not responsible for any injury you may have when using your commission due to lack of vision, mobility, or construction. This includes and is not limited to heat stroke, falling, tripping, weight of the commission, etc.

It is your responsibility to ensure you have a handler for creature costumes to help you in crowded areas as well as understand the limits of your body when using one of our props. It is important to take frequent breaks out of costume for water and fresh air. Please use caution and know your limits involving heat, weight, and vision.
